Hi,

Can I point out (and I believe certain points of law) that my company believe that any posting, closed group, direct messaging even email is non controlled and public even if intended as private. 
As explained to me “You might as well paint it on the side of a bus”

We are warned that any posting cannot be assumed to be confidential and can be openly examined 

My take is that as soon as you post anything, anywhere you have published it to everyone

correct, but that does not mean you can ignore the TOS, they are there for a reason, that reason is so we can retain control over the content posted by the rowdy rabble known as the members of the forum.the tos also cover all of the possible content that may contravene the laws of the land, and pertain to gdpr and safeguarding.

It is not law that we say "please" or "Thank you", nor is it law that one doesn't let a door slam in someone's face. There are many things that go towards making a civilised society that are not law.

I suppose it all rather depends on what you want in life.

i am sure someone will be along with a link soon, i am currently on the slowest internet connection i have found so far at womack staithe, its about as quick as the water point here.

These are the ToS that we all agree to when joining and remaining as members.

 

By accessing “The Norfolk Broads Network” (hereinafter “we”, “us”, “our”, “The Norfolk Broads Network”, “NBN") you agree to be legally bound by the following terms.

 

Member behaviour

The following rules apply to post contents, thread titles, quoting of postings, usernames, private messages and images used:  

 

By agreeing to sign up to this Forum you abide by the terms set out below failing which your membership will be terminated and you will be banned from future use.

 

 

General Data Protection Regulation (GDPR) - Right of Erasure (to be forgotten)


The GDPR introduces a right for individuals to have personal data erased. Upon request we will erase your Username, and email address and anonymise the posts held on the forum.

 

Process for not adhering to the Forum rules below


Some postings and the responses that they generate undermine the friendly and safe atmosphere of the forums and will not be tolerated. At their discretion the Moderating Team reserve the right to:

Delete or hide without warning any material that we deem to contravene these rules, any messages that may be offensive, or use insulting, threatening, troublemaking, provoking or otherwise aggressive language, or any member who consistently behaves inappropriately.

Issue warnings (Points)

The NBN Forum incorporates a warnings and Moderation Approval system. Members who break the forums rules will be issued with a formal warning by the moderation team and this will be recorded in the "Warning Points" underneath your messages.

Posting rights may need Moderation Approval or be restricted for a period of 1, 2 or 3 months. PM's are also restricted as they cannot be Moderated.

Forums members are only able to view their own warning status. ('0 points' means that you have no recorded warnings. This figure will increase if warnings are issued.) If you have received a warning from the forums team you can click on the warnings panel to find out why.

Members who persistently breach forums rules and reach 3 warning points may be banned either temporarily or permanently.

Have future postings pre-moderated or their user profile suspended.

Forums members are not to respond to postings of this nature but are required to report any material that they find offensive to a member of the forums administration team using the report button in the post.

Our decision is final in these matters and will be at the discretion of the forums team and no correspondence will be entered into.

Threads that do not fall exactly into one of the above categories, but which are deemed inappropriate due to their content or nature will also be deleted or moved.

We encourage good open discussion if kept friendly. The NBN does not condone or encourage potentially illegal activities. Any member doing so on this forum or our Facebook pages (including quoting of offending posts) will have their post hidden and may be banned without notice at the discretion of the moderators, their action is final. Discussing, without expressing an opinion for or against, the illegal activities of others without being considered to be condoning or encouraging them is acceptable.


 

1. Trolling

 

Trolling constitutes one or a series of posts from a user with the deliberate intention of inciting controversy or to cause annoyance or offence to other users. The content of a 'troll posting' may consist of:

 

1. A personal attack on other forums users (Direct or Implied)

2. An apparently foolish contradiction of common knowledge

3. A deliberately offensive insult to readers of a forum or discussion thread

4. A broad request for trivial follow-up postings

5. Any member who ignores the decision of the moderators, whether in relation to themselves or other members, and deliberately attempts to cause trouble


 

2. Discrimination and intolerance (E.G. Racism, Sexism, Ageism, Political and Religious Intolerance)

Intolerance of other people's politics, religious beliefs, culture, IQ, gender, physical or sensory impairments or age is unacceptable. As is knowingly posting false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violative of any law.

Breaching this rule may result in the entire thread being deleted and an immediate ban from the forums.

Forums members are asked to remember that other users may not have English as their first language and to extend the same courtesy and patience to others that they would wish to receive themselves.

 

3. Flaming

Flames - posts that are excessively abusive, attacking, threatening, or aggressive in nature - are unacceptable and will be removed without warning.

Whilst debating and discussion is fine, we will not tolerate rudeness, insulting posts, personal attacks, troublemaking or purposeless inflammatory posts.

 

 

4. Inappropriate Material

 

Confidential information

Forums members must not post confidential or other information that may infringe upon the privacy, proprietary or personal rights of others. This includes, but is not restricted to, personal telephone numbers, email and postal addresses. The NBN does not subscribe to 'naming and shaming'.  i.e. pictures or descriptions of accidents where either the boats or people are recognisable.

Details and photos of what a crew are wrongly doing or particular issues with a yard should not be reported here.  Reports to the concerned authorities are more appropriate.

Similarly, Private Messages or emails received via these forums are to be considered private and are not to be posted publicly unless the sender of the message agrees. By posting material, the posting party warrants and represents that it owns the copyright with respect to such material, has received permission from the copyright owner, or that the material is in the public domain.

 

Full Members Jokes section

Whilst the Jokes Section is in the Full Members and therefore restricted we are basically a Norfolk Broads family boating forum and so  jokes in poor taste or with implied obscenities may be deleted without recourse.

 

5. Post to inform other members that you are disgruntled and leaving the forum or intending to refrain from use

These are no longer acceptable practice on the Forum and will be deleted or hidden by the team

 

6. Advertising

Posting of unauthorised advertising is not permitted and will be deleted or hidden at the discretion of the team. We do allow Sponsorship of the Forum which does allow advertising, please contact the team to discuss if interested.

 

7. Abusive or offensive private messages

If you receive a message via the forums that you find inappropriate or offensive, place the sender on your block list. Then contact a moderator with details of the message contents and the sender.

The forums team will take what we deem to be appropriate action and if required, can verify details of alleged abuse by referring to the forums database or by checking the content of messages previously sent via these forums.

 

8. Defamation and Libel

Please be aware that posts made to the NBN website forums or private messages exchanged via the forums may be considered libellous, if the goal of these postings or messages are to damage the reputation of an individual or company.

Except for comments by moderators, the views expressed either on or via these forums are those of the author alone and are not necessarily endorsed or shared by the NBN

 


 

9. Cross-forum links

Due to a long-standing arrangement between forums, links to other Norfolk Broads forums and Facebook Groups etc are not permitted and will be automatically moderated by the forum software. Any links via URL-shortening services which ultimately resolve to such a site will also be removed.

 

10. Zero Tolerance

The NBN has a policy of Zero Tolerance for certain user behaviour. This includes but is not restricted to:

the unsolicited use of forum members' personal information

abuse of the forums private messaging and email systems

postings that display intolerance of other people's religious beliefs, culture, IQ, gender, physical or sensory impairments or age.

 

Please remember that we are not responsible for any messages posted. We do not vouch for or warrant the accuracy, completeness or usefulness of any message, and are not responsible for the contents of any message.

The messages express the views of the author of the message, not necessarily the views of this Forum. Any user who feels that a posted message is objectionable is encouraged to contact us immediately by email. We have the ability to remove objectionable messages and we will make every effort to do so, within a reasonable time frame, if we determine that removal is necessary.

 

11. Copyrighted material

You agree not to post any copyrighted material unless the copyright is owned by you or by this Forum.

This should be a Sticky at the top somewhere.

Am I honestly expected to remember in detail these 12 points in detail - that I signed up to when joining over ten years ago ?

I would have found it helpful to have been able to refer to this list following some recent unpleasant experiences, where decisions appeared to be somewhat arbitary.

I found them, without too much effort and I am no computer genius.

I work on the theory, be nice, life is too short for constant arguments.

They may not always seem to be right but the mods make the final decision.

Exactly !!

sadly it is a sign of the age we live in that these T.O.S. are needed , the NBN has always had the well deserved reputation of being the friendlier Broads forum and long may it remain so
