The reason for the yellow paint or any other colour is that it's been reported.... and the council inspector has come out to view it.... they will act on either it's an emergency to be filled with cold deferred tarmac straight away or they put it on a 7 day or 28 day order for it to be cut and patch with hot tarmac....

Also once it's been marked..... and you drive over it and damaged your wheel you can NOT claim.... because it's been reported and they are acting on it.... so they have the law on there side.... But if the repair hasn't been done in the time scale let's say after the 28 days is up and you hit it the following day on the 29th day they will have to pay up... problem most people have... is this they don't know how long the pothole has been there in the first place and when it was reported.... 

Now if you discover a pot hole and hit it.....what isn't marked and they tell you... oh it must of just appeared...... that doesn't happened... they just don't appear over night....  So when you report it record the time and date and find out what action there taking either an emergency action or a 7 or 28 day order.... also tell them your be notifying your insurance of it who will be contacting there claims department....
