Stopped for lunch at Irstead Parish Staithe yesterday, and delighted to be able to. For the record, I left my engine running until the boat was secure - as I ALWAYS DO, no apologies, to do otherwise is not good practice, simples. This is a matter of less than a minute, usually. No-one was bossing anyone about or recording anything. The notices are quite clear really and launching of anything is apparently not permitted. This is the case at several other staithes (B. Turf for example) - what legislation backs it up I am not sure. After a nice lunch we visited the delightful little thatched church. We then started our (outboard) engine before casting off, running it for a short while to be sure all was well, as we always do... My only regret? I guess they have the right to limit what goes on there. I don't agree with stifling reasonable and cheerful enjoyment, but I don't think the other restrictions are unreasonable. I don't always have the courage to ask people to turn off their blessed engines, so I have a degree of respect for the lady who does! Has anyone bothered to find out what legislation exists to support the signs, and to what degree it could be enforced? Easy to criticise without the facts IMHO... They can actually create bylaws in conjunction with the district council with regard to public walks and pleasure grounds under the 1875 Public Health Act. "Any [local authority] may purchase or take on lease lay out plant improve and maintain lands for the purpose of being used as public walks or pleasure grounds, and may support or contribute to the support of public walks or pleasure grounds provided by any person whomsoever. "Any [local authority] may make byelaws for the regulation of any such public walk or pleasure ground, and may by such byelaws provide for the removal from such public walk or pleasure ground of any person infringing any such byelaw by any officer of the [local authority] or constable." They can take over, maintain, improve, manage and control open spaces under the 1906 Open Spaces Act in conjunction with a District Council. You will note I mention 'in conjunction with a District Council'. A Parish Council is limited to what it can enforce to "Littering, graffiti, fly-posting, dog control offences (under its own Dog Control Orders)". Parish Councils are no longer allowed to create new Dog Control Orders but they are allowed to amend or revoke them. What they can amend is the number of dogs any one person can walk at a time the area that a DCO covers when the rules of the DCO must be obeyed whether dogs need to be on leads and how long the leads must be Parish Councils are allowed to issue fixed penalty notices but only in respect of Littering, graffiti, fly-posting, and dog control offences, but a Parish Councillor cannot issue that notice themselves. They have to employ someone to do this or use District Council enforcement staff. If a Parish Council intends to enforce Littering, graffiti, fly-posting, and dog control offences then they must post the notice that they intend to do so, and who their enforcement officer is. To be honest, unless you intend to drop leaflets onto the staithe, then put up flyposters, advertising that your forty-nine French Poodles and a Chihuahua will be performing a formation poopathon, which you don't intend to clean up after, using leashes of an unprescribed length, and then spray paint 'the Amazing Algernon and his Pooping Poodles Featuring Gomez the Chihuahua woz ere' on the signage that the Parish Council have erected telling you that they enforce littering, graffiti, fly-posting, and dog control offences and that the bloke in the corner house is a paid enforcement officer of the Parish or District Council...then you should be alright... 4 Quote Link to comment Share on other sites More sharing options...

'To clarify, the 24 hour free moorings at Irstead (as also at Barton Turf Staithe, Barton Turf ‘Paddy’s Lane’ and Barton Turf Gays Staithe) fall under the responsibility of the Broads Authority. The Broads Authority’s rangers oversee and ‘police’ them under their bylaws and mooring regulations. Barton Turf and Irstead Parish Council have not appointed anybody to act on its behalf in relation to these public moorings. The Parish Council is responsible for maintaining (grass cutting etc.) Irstead Staithe. I note your comments about views being expressed online about an ‘incident’ at Irstead Staithe.
